Campnetic Online Store (Bros Company GmbH) Terms and Conditions 

 

§ 1 Scope and Provider

(1) These eSHOP Terms and Conditions apply to all contracts concluded between Bros Company GmbH, represented by its managing partner Sören Balkenhol, Westfalenweg 279a, 42111 Wuppertal, email: info@campnetic.com (hereinafter: Seller) and the buyer via the Seller’s online store at www.campnetic.com. Any deviating terms and conditions provided by the customer will not be recognized unless the Seller expressly agrees to their validity.

(2) For the purposes of these eSHOP Terms and Conditions, “buyers” are consumers (Section 13 of the German Civil Code (BGB)). Pursuant to Section 13 of the German Civil Code (BGB), a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial nor their self-employed professional activities.

(3) We ship the goods worldwide.

§ 2 Conclusion of a Contract in the Online Store at www.campnetic.com

(1)The product descriptions in the store do not constitute legally binding offers.Rather, they are an invitation to buyers to submit a binding offer by placing an order.

(2) Submit bids via the online store at www.campnetic.com

By clicking the “Add to Cart” button, an item selected by the buyer in the online store is added to the store’s virtual shopping cart as a placeholder for a potential contract. Once the buyer has added all selected items to the shopping cart, they can proceed with the order process by clicking the“Checkout”button. The buyer is then directed tothe “Checkout”page. Here, the buyer must enter their address and contact information. Customers who have saved their information from a previous purchase can retrieve their existing details. Here, the customer selects their preferred payment method. If the buyer selects “Credit Card,” they must enter their credit card information. By clicking the “Review Order” button, they are taken to the order summary. There, after reviewing their order and details, they can complete the purchase by clicking the “Buy Now” button. If the customer selects PayPal, they must enter their PayPal account information. By clicking the “Pay with PayPal” button, they are redirected to PayPal. The customer can now review their order and details on PayPal and confirm the purchase. If the customer selects Klarna, clicking the “Review Order” button will redirect them to Klarna. After reviewing the details on Klarna, the customer can confirm their purchase there. In all cases, the following applies: Until the customer clicks the “Buy Now” button during the order review, they can go back through the individual steps at any time to correct any errors. Once the “Buy Now” button is clicked, no further corrections are possible. The customer’s binding offer to enter into a contract is then transmitted to the seller. The buyer is provided with the order number. The seller immediately notifies the buyer of the receipt of the order via email.However, confirmation of receipt of the order does not yet constitute acceptance of the purchase offer.

(3) The seller is authorized to accept an order received from the buyer withintwo daysof its receipt. The sales contract between the seller and the buyer is concluded only upon the seller's acceptance of the offer.

(4) If the Seller’s order confirmation contains typographical or printing errors, or if the price specifications are based on transmission errors caused by technical issues, the Seller is entitled to contest the order, provided that the Seller bears the burden of proving the error. Any payments already made shall be refunded to the buyer without delay.

(5) The Seller shall store the text of the contract after its conclusion and send the Buyer the order details and these eSHOP Terms and Conditions via email. The Buyer may also view the eSHOP Terms and Conditions at any time on the Seller’s website. The buyer can view past orders in the seller’s customer login area, provided the buyer has registered with the seller and set up a customer account.

§ 3 Prices

(1) The prices listed on the product pages of the online store include the applicable value-added tax and other price components. The applicable value-added tax is also always shown separately. However, these prices do not include delivery and shipping costs, unless shipping and/or packaging are free of charge.

§ 4 Shipping Costs

(1) Shipping costs and the delivery method for the items are displayed to the buyer during the ordering process in the online store.

§ 5 Terms of Delivery and Reservation of the Right to Self-Delivery

(1) Items are shipped via standard parcel services.

(2) Unless otherwise stated in the online store, items will be delivered within five days. The seller will indicate any different delivery times or unavailability on the respective product page in the online store and/or in person.

(3) In the case of payment in advance, the delivery period begins on the day after the payment order is issued to the transferring financial institution, If the last day of the delivery period falls on a Saturday, Sunday, or a public holiday recognized by the government at the place of delivery, that day shall be replaced by the next business day (Mon–Fri).

 (4) If the item is unavailable because the seller has not received it from its supplier through no fault of its own, the seller may withdraw from the contract. In this case, the seller will inform the buyer immediately and, if applicable, offer to deliver a comparable item. If no comparable item is available or the buyer does not wish to receive a comparable item, the seller will promptly refund any payment already made by the buyer.

(5) Delivery will be made by mail to the delivery address provided by the buyer, provided that it is located within the specified delivery area.

§ 6 Terms of Payment 

(1) Before beginning the ordering process, the buyer is separately informed in the online store about the payment methods generally accepted by the online store. Payment is made in advance or, if this payment method is enabled for the specific transaction and buyer.

(2) If the buyer selects PayPal as the payment method, the payment is processed by redirecting the buyer to PayPal.

(3) If the buyer selects Klarna as the payment method, the payment is processed via a redirect to Klarna.

(4) If the buyer selects credit card as the payment method, the buyer pays with his or her credit card.

§ 7 Consumer Right of Withdrawal      

As a consumer, you have the right to cancel.

You have the right to cancel this contract within 30 days without giving any reason.

 

The cancellation period is 30 days from the day on which you, or a third party designated by you (other than the carrier), took possession of the last item.

by means of a clear statement (e.g., a letter sent by mail or an email) regarding your decision to withdraw from this contract. You may use the attached sample withdrawal form for this purpose, although its use is not required.

 

To comply with the cancellation period, it is sufficient for you to send the notice of your intention to exercise your right of cancellation before the cancellation period expires.

 

Consequences of the Revocation

If you cancel this contract, we must refund all payments we have received from you, excluding shipping costs, without delay and no later than fourteen days from the day we receive notice of your cancellation of this contract. We will use the same payment method you used for the original transaction for this refund, unless we have expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs first. You must return the goods immediately and, in any case, no later than fourteen days from the date on which you notify us of your cancellation of this contract, to

to return the goods. The deadline is met if you ship the goods before the fourteen-day period expires. We will cover the cost of returning the goods from within Germany. Returns from abroad must be arranged by the customer. The customer is responsible for the costs of these returns from abroad. You are only liable for any loss in value of the goods if this loss is attributable to handling of the goods that goes beyond what is necessary to assess their condition, characteristics, and functionality.

§ 8 Damage During Transport

The following applies to consumers:

(1) If items are delivered with obvious damage caused during shipping, the buyer is asked to report such damage immediately to the delivery company and to contact the seller as soon as possible by email at info@campnetic.com. The buyer is not obligated to do so.

(2) Failure to file a complaint or contact the seller has no effect on the buyer’s statutory warranty rights. However, the buyer assists the seller in asserting his claims against the carrier or the transport insurance provider.

§ 9 Warranty and Liability

(1) The warranty/liability for defects is governed by the provisions of law.

Product Safety and Vehicle Use Notice:
Our magnetic products are designed for normal, proper use on vehicles. When used properly, they generally do not cause any damage. However, it is the customer’s responsibility to ensure that the vehicle’s surface is clean, dry, and free of dirt or metal particles before attaching the product.

In some cases, prolonged use, heat buildup, or dirty contact surfaces may cause slight marks or pressure marks to appear on the paint surface. These generally do not cause permanent damage and can usually be removed by cleaning or polishing.

The installation of our products is expressly at your own risk.
Campnetic assumes no liability for paint damage, scratches, dents, or other changes to the paint surface resulting from the use of the product, improper use, dirty surfaces, prolonged attachment, or mishandling.

Note on Care, Maintenance, and Outdoor Use:

Products that are permanently or regularly exposed to the elements must be cleaned, maintained, and inspected for proper functioning on a regular basis. In particular, threaded parts, fasteners, and connecting elements, as well as other metal components, must be inspected at appropriate intervals for tightness, wear, corrosion, and damage, and treated with suitable maintenance and corrosion protection products as needed.

This is especially true after extended periods of non-use, as well as after exposure to high levels of moisture, salt, dirt, or other environmental factors.

Even when high-quality materials are used, natural signs of wear and aging can occur due to environmental factors such as moisture, precipitation, salt, dirt, temperature fluctuations, and UV radiation. These include, in particular, corrosion, discoloration, surface changes, stiffness, and the seizing of threads and fasteners.

Damage, malfunctions, or signs of wear and tear resulting from a failure to perform, or from inadequate or improper care, cleaning, maintenance, or storage do not constitute grounds for claims based on material or manufacturing defects.

§ 10 Alternative Dispute Resolution pursuant to § 36 VSBG:

We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final Provisions - Jurisdiction

(1) Should any single provision of these General Terms and Conditions be invalid, the remaining provisions shall remain in effect.

(2) The language of the contract is German.

(3) Any disputes arising out of or in connection with this agreement shall be governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods. This choice of law applies to consumers only if it does not conflict with mandatory consumer protection provisions of the country in which the consumer has his or her habitual residence at the time of placing the order.

(4) If the buyer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the buyer and the seller shall be the seller’s place of business.
